SUMMARY OF CMR CHANGES

The main changes to be implemented under Cargo Management Re-Engineering are set out below. These changes are meant to be implemented between 1 July 2002 and June 2004. 

  • the establishment of an electronic business environment with mandatory electronic reporting of certain information to Customs using an integrated computer system;

  • the introduction of streamlined reporting mechanisms, declaration procedures and payment options for importers and exporters who meet certain criteria – Accredited Client Scheme – including Duty Deferral;

  • simplified processes for declaring imports – 3 levels of Customs Clearance + Accredited Client Scheme;

  • new reporting measures for imported cargo;

  • changes to the way exported cargo is reported and cleared;

  • new document and record retention requirements – both importers, exporters & customs brokers will be required to keep documents evidencing import & export transactions for a period up to 5 years;

  • changes to cost recovery arrangements;

  • new monitoring powers – to enter premises to examine import / export documents and goods;

  • clarification of examination powers for goods destined for export that are not yet under Customs control;

  • extension of the period for the recovery of short paid Customs duty from 12 months to 4 years after an importation, however Customs Duty refunds will be able to be claimed for a similar period (currently also 12 months); and

  • the most far reaching change for importers and exporters we believe is the new infringement notice system / strict liability penalty system for dutiable and non-dutiable errors in regard to imports, exports, cargo and other reports to Customs.
